Skillshare (including “we,” “us,” or “our") may offer for purchase in certain geographical areas a “Gift Membership,” which is offered in the form of a claim code redeemable on Skillshare.com, and which allows an individual or entity (the “Purchaser”) to purchase a limited-time membership on behalf of themselves or someone else (the “Recipient”). Unlike other Skillshare subscriptions, Gift Memberships are non-renewing and allow access to the relevant Services by the Recipient only from the date the Recipient redeems the Gift Membership for the duration of the membership purchased (the “Gift Term”). By purchasing or making use of a Gift Membership, you agree to the terms and conditions that follow (the “Gift Membership Terms”), as well as our Terms of Service and Privacy Policy. Do not purchase or make use of a gift membership if you do not agree with any of these terms.  

Any capitalized terms that are not defined in these Gift Membership Terms are defined as specified in the Terms of Service.

Purchasing and Redeeming a Gift Membership

Gift Memberships can be purchased only through official Skillshare channels. At the time of purchase, the Purchaser will choose the Recipient and the Gift Term. The Purchaser may also be required to provide a valid email address for the Recipient, which email address will be used to provide the Recipient with the purchased Gift Membership. Skillshare is not responsible and assumes no liability for non-delivery of a Gift Membership and/or a Gift Membership-related email because of an invalid or incorrectly-provided email address, spam filters, or any other reason. Skillshare is not responsible if any Gift Membership is lost, stolen, destroyed, or used without permission.

In order to redeem a Gift Membership, a Recipient must have an existing Skillshare account or create a new Skillshare account, and thereby must agree to be bound by all applicable terms, conditions, and policies. If the Recipient has an active Skillshare subscription, the Gift Membership will extend the term of their active subscription by the Gift Term. Each Gift Membership may only be redeemed once. Skillshare may, in its sole discretion, advise the Purchaser when the Recipient has redeemed the Gift Membership. 

Gift Membership Limitations

Claim codes for Gift Memberships cannot be reloaded, resold, transferred, redeemed for cash, or applied to any other Skillshare Service other than a Skillshare subscription, except where required by law. Unless you obtain Skillshare’s written consent, Gift Memberships may not be used in connection with any marketing, advertising, or other promotional activities of any kind, including, without limitation, via websites, internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, sweepstakes, contests, or radio and television broadcasts.

Skillshare makes no warranties, express or implied, with respect to Gift Memberships, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In the event a Gift Membership is non-functional, your sole remedy, which is not guaranteed, and Skillshare’s sole liability, will be the replacement of such Gift Membership. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

Refunds and Validity

Gift Memberships are not refundable except as required by applicable law. A Gift Membership is not valid and will not be honored, and Skillshare will not be liable for the value of any Gift Membership, if that Gift Membership is obtained from an unauthorized seller or reseller, including, without limitation, through any internet auction site. 

Skillshare reserves the right to refuse to honor a Gift Membership if we, in our sole discretion, suspect that the Gift Membership was sold or obtained fraudulently. Skillshare reserves the right to refuse to honor any Gift Membership in the event of a disputed credit card charge or other failure of consideration. 

Changes to the Gift Membership Terms

Skillshare reserves the right to modify, alter, change, or amend these Gift Membership Terms from time to time in our discretion without advance notice. By purchasing or using a Gift Membership after any such changes, you will be deemed to have accepted the updated Gift Membership Terms.
